The petitioner being the husband of the daughter of the informant namely Gyanti Devi is apprehending his arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code Act.

The prosecution case is of killing the daughter of the informant after six years of marriage by hanging her for non fulfillment of the dowry demand.
It is submitted by learned counsel for the petitioner that the daughter of the informant committed suicide and the petitioner was not present at the place of occurrence. It is further submitted that the children of the victim are minor and the
Patna High Court Cr.Misc. No.30758 of 2016 (2) dt.28-07-2016 2/2 petitioner is taking care of them as a result of the informant has retracted from his initial version and filed a petition to that effect before the learned court below.
Considering the nature of accusation this court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with (Pakribarawan) Dhamaul P.S. Case No. 208 of 2015 pending in the court of Sri N.K. Singh Judicial Magistrate, 1st Class, Nawada.
Accordingly, the application is disposed of.
