The petitioner is seeking anticipatory bail in connection with Mali P.S. Case No.22 of 2024 registered for the offence punishable under Sections 366, 376-D, 384 / 34 of the Indian Penal Code.

As per the prosecution case, the petitioner and co-accused Ravi Kumar forcibly took away the victim to the house of co-accused Ravi Kumar and thereafter they took her to Aurangabad where she was raped by co-accused Ravi Kumar. 4.

It has been submitted by learned counsel for the petitioner that the main allegation of rape is against Ravi Kumar and not against this petitioner.

Since the petitioner has participated in the

Patna High Court CR. MISC. No.27194 of 2024(2) dt.01-05-2024 2/2 kidnapping of the victim girl, I am not inclined to grant him anticipatory bail. Accordingly, this anticipatory bail application is rejected.
