When the matter has been taken up for consideration, a counter-affidavit is being filed on behalf of the respondent no. 1 and 2, which is taken on record.

In paragraph-9 of the aforesaid counter-affidavit, it has been stated that no candidate was found suitable in the impugned selection process. Therefore, a fresh advertisement shall be issued for appointment of dealership for the location in question. In view of the averments made in the aforesaid counteraffidavit, claim raised on behalf of the petitioner in the present writ petition has become infructuous.

Accordingly, the writ petition stands dismissed. However, it goes without saying that if any fresh advertisement is issued and the petitioner applies and fulfils the condition, then her claims shall also be considered in accordance with law. (Birendra Prasad Verma, J) BTiwary/- U
