JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 29-09-2015 The petitioner, who holds PDS licence bearing licence No.10 of 1986 within Sheikhpura district, seeks quashing of order dated 27.6.2013 passed by the Sub Divisional Officer, Sheikhpura by which his licence has been cancelled.
The petitioner submits that a copy of the inspection report has not been provided to him which has been referred to in the show cause as well as cancellation order. He further submits that he has specifically taken a point in paragraph 5 of the show cause that no one has made any complaint against him in course of inspection of his shop.
If the submission of the petitioner is correct, the same would require due consideration.
Patna High Court CWJC No.15720 of 2013 (4) dt.29-09-2015 In the result, this writ application is disposed of with liberty to the petitioner to move the Appellate Court in the matter who would duly consider the point taken by the petitioner. In case, an appeal is filed, the delay in filing of the same would be condoned as the petitioner was pursuing his remedy before this Court. It is expected that the appeal would be disposed of within four months from the date of its filing.
