The petitioners apprehend their arrest in a case registered for the offences punishable under Section 376 and other allied sections of the Indian Penal Code. As per the prosecution case, co-accused Mukesh Dhangad called the informant at his house and on the pretext of marriage, established physical relation with her. It is further alleged that these petitioners assaulted the informant and ousted her from their house.

Specific allegation of sexual assault is against co-accused Mukesh Dhangad and no specific overt act has been alleged against petitioners. Petitioners have been made accused in this case only because they are parents of Mukesh Dhangad. Petitioners claim clean antecedent. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge 7th-cum-Special Judge POCSO, Bettiah, West Champaran in connection with Bagaha Mahila P.S. Case No. 42 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
