Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 353, 379, 504, 506 of the Indian Penal Code. The prosecution case is that the informant being the Headmaster of the Government Middle School, Dihathi, was busy in distributing the scholarship money to S.C, B.C.-I and B.C.-II categories students, in the meantime, the petitioner came and made enquiry with regard to distribution of scholarship to general categories students thereafter abused the informant and took away cash Rs. 80,000/- along with school register.
It is submitted by the learned counsel for the petitioner that petitioner simply made protest for not distributing the scholarship money to the general category
Patna High Court Cr.Misc. No.30839 of 2016 (2) dt.03-08-2016 students. During investigation it was only found that the petitioner took some register of the school, which was returned by him. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sahiyara P.S. Case No. 91 of 2015, pending in the court of learned Sri Kumar Dhirendra Rajajee, J.M., Ist Class, Sitamarhi. With the above observation this application is disposed of.
