JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-11-2019 The petitioner seeks quashing of the order dated 11.12.2014 passed by the learned Special Judge, Tirhut Area, NBPDCL, Muzaffarpur in connection with Tr. No. 321 of 2014, arising out Aurai P.S. Case No. 27 of 2013, whereby cognizance has been taken under Section 379 of the Indian Penal Code and Section 135 of the Electricity Act.

From the perusal of the records, it appears that no interference is required with the order of cognizance. It would be open for the petitioner to approach the authorities for compounding of the offence under

Patna High Court CR. MISC. No.3696 of 2018(2) dt.19-11-2019 2/2 135 of the Electricity Act. It would also be open for the petitioner to seek discharge for the offence under Section 379 of the Indian Penal Code.

The petition stands dismissed with the aforesaid observation.
