BADAR ORAL ORDER 05-01-2022 The applicant/accused in Crime No.672 of 2020 registered with Police Station-Sarai for the offences punishable under Sections 399, 402 of the Indian Penal Code as well as under Sections 25(1-b)a, 26 and 35 of the Arms Act and also under Sections 20/22 of the N.D.P.S. Act, by this application is seeking his release on bail during the pendency of the trial. Heard learned counsel appearing for the applicant/ accused. He submits that only 600 grams Afeem is alleged to have been recovered from the applicant and this quantity is an intermediate quantity as per the N.D.P.S. Act. The applicant is behind the bars from 10.10.2020.

The learned A.P.P. opposed the application.

Though the applicant is not stated to be having any criminal antecedents, he was caught red handed with a firearm

Patna High Court CR. MISC. No.33825 of 2021(2) dt.05-01-2022 2/2 and a live bullet apart from 600 grams opium. In this view of the matter, I am not inclined to grant bail to the applicant at this stage. I am of the considered opinion that the trial needs to be expedited and therefore the following orders:

(I). The application is rejected.

(II). The learned trial court is directed to expedite the trial and to finish it within a period of eight months from today.

(III). The applicant shall be entitled to renew the prayer if the trial is not finished with the time framed prescribed by this Court.
