Heard learned senior counsel for the petitioner and learned A.P.P. for the State, Mr. Chandra Bhushan Prasad. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 279, 336, 337, 338, 304A, 304 and 34 of the Indian Penal Code and Sections 153 and 154 of Railway Act, 1989.

Learned senior counsel for the petitioner submits that the case of the petitioner, if not akin, is similar to that of Anil Kumar, who had moved this court seeking anticipatory bail by filing Cr. Misc No. 27844 of 2024, and the same was allowed by an order dated 30-4-2024. It is thus submitted that the petitioner, based on parity, be also granted the privilege of anticipatory bail. No.28724 of 2024(2) dt.30-04-2024 2/2 in between the case of the instant petitioner and Anil Kumar, is that no departmental proceeding was initiated against the present petitioner. It is also submitted that the petitioner will not abscond rather will cooperate in the investigation, which is still pending.

Learned A.P.P. for the State, Mr. Chandra Bhushan Prasad opposes the prayer for anticipatory bail of the petitioner. 5.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sonepur (Hajipur) Rail P.S. Case No. 22 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
