2. The petitioner seeks bail in connection with Khagaul P.S. Case No. 60 of 2025 instituted for the offences punishable under Sections 316(2), 318(4), 338, 336(3) and 340(2) of the B.N.S.
3. Allegation against the petitioner and other coaccused persons is to have cheated the money from the informant due to getting job.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that petitioner is a lady aged about 50 years having got clean antecedent. He further submits that the petitioner did not cheat the informant because she is an office stall of other co-accused namely Guddu
Patna High Court CR. MISC. No.25643 of 2025(3) dt.06-05-2025 2/3 Kumar. He next submits that the specific allegation upon the petitioner is that she filled up form of the informant as office staff, except this there is no other allegation against her. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 13.02.2025.
5. Learned APP opposes the prayer for bail.
6. From perusal of the FIR and impugned order of the learned Additional Sessions Judge-I, Danapur dated 17.03.2025, it appears that petitioner is named in the FIR. From perusal of the records, it appears that on the basis of written report of the informant namely Gautam Kumar, FIR has been lodged under Sections 316(2), 318(4), 338, 336(3) and 340(2) of the B.N.S. against two accused persons including the present petitioner. It also appears that petitioner is a lady and one accused Rohit Kumar @ Guddu has already been granted bail by the learned Trial Court in B.P. No. 345 of 2025 dated 29.04.2025, so considering all these aspects of the matter and submission of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.
7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two
