JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kursakanta Police Station Case No. 55 of 2015, disclosing offences under Sections 147/149/341/323/ 354A/448/379/504/506 of the Indian Penal Code and Sections 3/4 of the Witch Act.

Learned Counsel for the petitioner appears to be right in his submission that similarly circumstanced coaccused persons have been granted anticipatory bail by this Court vide orders, dated 04.08.2015, 12.01.2016 and 26.05.2016, passed in Criminal Misc. Nos. 31314 of 2015, 750 of 2016 and 21378 of 20165, respectively. Considering the above submission, this

Let the petitioner, Sita Devi, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri A. B. D. Dubey, Judicial Magistrate, 1st Class, Araria, in connection with Kursakanta Police Station Case No. 55 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
