The petitioners apprehend their arrest for the offences punishable under sections 341, 323, 385, 379 and 406 of the Indian Penal Code.
The complainant alleged that he took three kathas of land on lease for ten years from the petitioners on a rent of Rs. 15,000/- per year, the complainant paid rent of the land till the year 2013 but the petitioners demanded rangdari of Rs. 1,00,000/- besides the regular rent of the land.
It is submitted that the complainant did not pay any rent to the petitioners and when the petitioners demanded rent of
Patna High Court Cr.Misc. No.51934 of 2015 (2) dt.22-12-2015 2/2 the land the complainant filed this complaint case making false allegation and in fact the petitioners are owner of the land who had given their land on rent to the complainant for starting the business of brick kiln.
Considering the facts aforesaid, the petitioners, above named, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Gopalganj in Complaint Case No. 1418 of 2014/ Trial No. 2798 of 2015, subject to the conditions as laid down in section 438 (2) of the Code of Criminal Procedure, 1973.
