JUSTICE RAVI RANJAN ORAL ORDER 29-08-2016 I have heard learned counsel for the petitioner and the State.
The petitioner apprehends his arrest in a case registered for offences punishable under Sections 414, 420, 120B, 201/34 of the Indian Penal Code and 47 A of the Excise Act. It is contended that the concerned case was registered on 2.2.2016, i.e., prior to the amendment in the Excise Act. Allegedly some bottles of foreign liquor, one Seiko watch and foreign cigarettes were recovered from an almirah in the house of the petitioner. It appears from the allegation that the same is centered against the husband of the petitioner, namely, Binod Singh @ Binod Kumar Singh who has already been granted
Patna High Court Cr.Misc. No.29572 of 2016 (2) dt.29-08-2016 2/2 anticipatory bail vide Annexure 2 by a coordinate Bench of this Court.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Mamta Kumari be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Magadh Medical College P.S. Case No. 16 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate IV, Gaya subject to the conditions as laid down under subsection(2) of Section 438 of the Code of Criminal Procedure. (Dr. Ravi Ranjan, J) Spd/- U T
