In this case, the petitioner is seeking anticipatory bail in connection with Dumra P.S. Case No.50 of 2016, registered for the offence punishable under Sections 406, 409, 420 and 427 of the Indian Penal Code.
As per the allegation, the petitioner was posted as Assistant Co-operative Officer and was deputed as In-charge of Purchase Centre along with one Rahul Kumar. Allegation has been made that the petitioner and one Rahul Kumar defaulted 126.10 quintals of paddy.
It appears that when the petitioner came to know about the said loss, he immediately within a period of 10 days
Patna High Court Cr.Misc. No.28651 of 2016 (2) dt.26-07-2016 2/2 deposited his half share of loss to the tune of Rs.1,01,788/-. Looking to the nature of allegation and the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P.S. Case No.50 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
