Petitioners apprehend arrest in connection with Jay Nagar P.S. Case No. 86 of 2018 registered for the offence punishable under sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act. The seizure list reflects recovery of 960 bottles of Nepali liquor.

Learned counsel appearing for the petitioners submits that petitioners have falsely been implicated in this case on basis of confessional statement of the co-accused. Nothing

Patna High Court CR. MISC. No.25047 of 2019(2) dt.18-04-2019 2/2 has been recovered from the conscious possession of these petitioner. The alleged recovery is from a Mango Orchard with which petitioners have no concern. Petitioners are men of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise Act, Madhubani in connection with Jaynagar P.S. Case No. 86 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
