In this case, the petitioner is seeking anticipatory bail in connection with Kudra P.S. Case No.146 of 2016, registered for the offence punishable under Sections 409 and 420 of the Indian Penal Code.

The petitioner being the owner of Singh Rice Mill, entered into an agreement with S.F.C. for milling paddy. S.F.C. provided 4,500 quintals of paddy and after milling, 3,015 quintals of rice was required to be provided, but the petitioner has only given 1,078.92 quintals of rice and remaining 1,938 quintals of rice was not given despite several reminders.

Patna High Court Cr.Misc. No.26779 of 2016 (2) dt.04-07-2016 2/2 Learned counsel for the petitioner states that the petitioner is ready to deposit 25% of the amount mentioned in the FIR. If the petitioner deposits 25% of the amount mentioned in the FIR within a period of four weeks from today, the petitioner would be released on bail in the event of arrest or surrender within four weeks from today on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Kudra P.S. Case No.146 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. In failure to deposit the said amount, this order will be treated to have been withdrawn.
