The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 365, 366A/34 of the Indian Penal Code.
Accusation is of kidnapping the daughter of the informant by the petitioner and Raju Kumar. In 164 Cr.P.C. statement the victim has named Raju Kumar, Kunal Kumar and the petitioner.
It is submitted by the learned counsel for the petitioner that during course of investigation the petitioner was not sent up for trial and only Raju Kumar was charge-sheeted, but differing with the Final Form cognizance has been taken against the petitioner also. Considering the fact that the petitioner was not

No.56551 of 2015 (2) dt.14-12-2015 sent up for trial on conclusion of investigation and statement has been made in para-3 of the petition that petitioner has no criminal antecedent, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Maner P.S. Case No. 183 of 2011, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
