JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Haspura P.S. Case No. 183/18, registered for the offences punishable under Sections 302/120B of the Indian Penal Code. Prosecution case is that father of the informant was found missing from the house and on search, his dead body was recovered and informant and others suspected the hands of petitioner and his father and other accused persons in the murder of the deceased.

Submission of learned counsel for the petitioner is that he has been made accused in this case only because, he happens to be son of Jangi Yadav, with whom the informant's father had land dispute. Moreover, father of the petitioner and others, who were having dispute with the father of informant has already been enlarged on bail by a coordinate Bench of this

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Haspura P.S. Case No. 183/18, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the trial court, failing which, the prosecution shall move for cancellation of bail bonds.
