JUSTICE ARUN KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 7 of Essential Commodities Act. Allegation in brief is that Rice Meal was supplying the rice to S.F.C. the rice is of P.D.S. shop. Rice Mill was later on raided by the informant and 540 bags of rice loaded on a truck and 20 bags unsealed rice in godown were found along with two machines for stitching bags.
Submission is that there was an agreement between the petitioner's Rice Mill and S.F.C. for supplying the rice after milling of paddy. The petitioner was supplying the rice after milling paddy as per contract and there is no material to connect that the rice being loaded at S.F.C. and found in the godown of the petitioner is of any P.D.S. shop. This petitioner has got no criminal antecedent.

No.30366 of 2017 (2) dt.07-07-2017 2/2 Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Neeraj Shankar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub. Divisional Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No.88 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
