2. The petitioner seeks bail in connection with Madanpur P.S. Case No. 01 of 2023, dated 01.01.2023, instituted for the offences punishable under Sections 307, 323, 504, 147, 148 and 149 of the Indian Penal Code and 27 of the Arms Act.
3. The prosecution case, in short, is that on 22.12.2022, at about 09:30 am, informant enquired co-accused for payment of outstanding amount of Rs. 1,62,000/- (One Lakh Sixty Two Thousand) on which he assaulted and injured the informant. It is further alleged that at about 10:30 am, coaccused persons along with the petitioner assaulted and cause injury to informant and his brothers and two co-accused persons
Patna High Court CR. MISC. No.25552 of 2023(2) dt.23-05-2023 2/2 fired a gun shot on informant and his brother respectively.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It is submitted that there is no specific allegation against the petitioner in this case. It is further submitted that the specific allegation is against the co-accused, namely, Murari Prasad Soni, Bipin Prasad Soni and Balwant Kumar Soni. Further, it is submitted that the injuries sustained by the informant and others are simple in nature. Lastly, it has been submitted that the petitioner is in custody since 18.03.2023, has one criminal antecedent and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Aurangabad in Madanpur P.S. Case No. 01 of 2023.
