2. The petitioner seeks bail in connection with Lakhaura P.S. Case No. 218 of 2024 registered for the offence punishable under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, the petitioner along

Patna High Court CR. MISC. No.24103 of 2025(6) dt.01-09-2025 2/3 with other co-accused persons are said to have assaulted the informant and his father with lathi, danda and knife due to which they sustained serious injury.

4. The petitioner is the order-giver.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 19.12.2024.

6. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for regular bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Lakhaura P.S. Case No. 218 of 2024, subject to the condition that the petitioner will co-operate in the trial. Re.: Cr. Misc. No. 39601 of 2025

10. As per the prosecution case, the petitioner along with other co-accused persons are said to have assaulted the informant and his father with lathi, danda and knife due to which they sustained serious injury.

11. The petitioner is one of the assailants of the deceased. He has stabbed the deceased. The post-mortem supports the prosecution case. The petitioner is in custody since 17.12.2024.

12. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for regular bail of the petitioner.

13. Considering the fact that the petitioner is one of the assailants of the deceased, I am not inclined to grant bail to the petitioner.
