Petitioner apprehends her arrest in connection with Bathnaha P.S. Case No. 15 of 2017, registered for the offences punishable under Sections 363 of the Indian Penal Code and subsequently Sections 302 and 120B of the Indian Penal Code. It has been alleged that the son of the informant, went to play and did not return. The informant is said to have enquired from the people of the village, however, the son of the informant could not be traced. Subsequently, the dead body of the son of the informant has been recovered.
Learned counsel for the petitioner submits that the case has been initiated against the petitioner merely on the basis of
Patna High Court Cr.Misc. No.32550 of 2017 (2) dt.13-07-2017 2/2 suspicion. Her husband has been granted regular bail by a coordinate Bench of this Court vide order dated 03.05.2017 passed in Criminal Miscellaneous No. 14328 of 2017 and the petitioner has a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to grant anticipatory bail to the petitioner.
Accordingly, let the abovenamed petitioner, in the even of her arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S. Case No. 15 of 2017 subject to the conditions enumerated under Section 438 (2) of Code of Criminal Procedure.
