The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 420 and 379 of the Indian Penal Code.

The prosecution case is that the Hywa truck of the informant, being driver of the truck, was forcibly taken away by the accused persons including the petitioner. Though, the said Hywa truck was purchased by its owner from the registered owner namely Sujit Kumar on payment of Rs.16,00,000/- which was initially financed by the Runjhun Bond Finance Company but the said company after receiving the payment of loan amount issued N.O.C.

It is submitted by learned counsel for the petitioner that petitioner is the agent of re-possession agency and the

Patna High Court Cr.Misc. No.53087 of 2015 (2) dt.23-11-2015 2/2 vehicle in question being taken in possession for default of repayment of loan amount on 26.05.2014, whereas the FIR was registered on 16.08.2014.

Considering the nature of accusation, it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Nawada Muffasil P.S. Case No.106 of 2014, pending before the learned CJM, Nawada.

With the above observation, this application is, accordingly, disposed off.
