Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 447, 448, 380, 427, 307 and 504/34 406 and 420 of the Indian Penal Code, registered in connection with Babubarhi P.S.Case No. 140 of 2020 (C.R.I. No. 972 of 2020).

As per allegation, the accused persons named in the FIR started throwing stones and co-accused Prince Mehta fired shot on Madhav Mehta and made him injured. The specific allegation against the present petitioner is that he also fired shot, but none has sustained injury.

The learned counsel for the petitioner has submitted that there is land dispute between the parties and there is case

Patna High Court CR. MISC. No.33540 of 2021(2) dt.05-04-2022 2/2 and counter case. Although there is allegation of firing against the petitioner, but none injured. He has submitted further that the petitioner is a person of clean antecedents. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Madhubani in connection with Babubarhi P.S.Case No. 140 of 2020 (C.R.I. No. 972 of 2020), subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
