The petitioner, has invoked the writ jurisdiction of this court under Article 226 of the Constitution of India , with a prayer to direct the respondents to select him as Home Guard in Sonebarsa Block under Saharsa district and has also prayed for cancelling the selection of respondent no. 6. It has been alleged that respondent no. 6 on the strength of false residential certificate was selected. In the counter affidavit a specific stand has been taken that petitioner's name has not appeared in the selected list which was published. In respect of respondent no. 6 a specific
Patna High Court CWJC No.16758 of 2011 (6) dt.22-07-2016 2/2 stand has been taken that the respondent no. 6 did not come to join on the selected post and as such there was no question for further verifying his residential certificate. Keeping in view the fact that respondent no. 6 has not been allowed to join as well as the fact that in the select list petitioner's name has not appeared, there is no reason to pass any favourable order.
The writ petition stands dismissed.
