The petitioner apprehends his arrest in a case registered for offences punishable under Sections 420, 379, 414 and 34 of the Indian Penal Code and 21 of M.M.R.D.Act.
As per allegation coal dust was being unloaded from the truck after mixing it with coal and which was being sold from the shop of the petitioner. It is stated that three persons were apprehended and disclosed that they work for the petitioner. It is contended that the petitioner is not involved in such activity and he was never implicated in such matter on any earlier occasion. Though he is involved in two cases, one is registered under Sections 323 and 341 of the Indian Penal Code
Patna High Court Cr.Misc. No.31225 of 2016 (2) dt.09-08-2016 2/2 and another is registered under Section 307 of the Indian Penal Code which were lodged due to enmity with the villagers. Having regard to the facts and circumstances of the case, let petitioner, namely, Sudhir Yadav be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Rajauli P.S. Case No. 44 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
