JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-11-2022 The learned counsel for the petitioner has referred to Annexure-5 to the writ petition, which is a notice dated 29.06.2019, issued by the Circle Officer, Bahadurpur, to the encroachers to remove the encroachment voluntarily, failing which action shall be taken by the administration to remove the same, to submit that till date no action has been taken by Circle Officer, Bahadurpur.

Having regard to the limited relief sought for by the petitioner, I deem it fit and proper to grant liberty to the petitioner to file appropriate representation before the Circle Officer, Bahadurpur, for redressal of his grievances regarding non-removal of encroachment from the land bearing Khata No.

Patna High Court CWJC No.9708 of 2020(2) dt.02-11-2022 2/2 2092, khesra no. 5436 situated at panchayat Udhra, Mahapada, Village Daing, P.S.- Bahadurpur, District-Darbhanga which is gairmajarua aam land as also for compliance of his own order dated 29.06.2019, apart from taking action in pursuance to the final order, passed in connection with Encroachment Case No. 3 of 2018-19. It is needless to state that the Circle Officer, Bahadurpur, shall take appropriate action, in accordance with law, within a period of eight weeks of filing of such representation by the petitioner.

The writ petition stands disposed off on the aforesaid terms.
