Petitioner seeks regular bail in connection with Dumraon PS Case No. 22/2021 registered for the offences punishable under Sections 399, 402 of the IPC and Section 25(1-b)a, 26 35 of the Arms Act.

The police, on the basis of secret information that some miscreants have assembled near pipe factory and planning to commit the crime, proceeded towards the place of occurrence and recovered one country made pistol and one live cartridge from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged

Patna High Court CR. MISC. No.33543 of 2021(2) dt.20-12-2021 2/2 and he has falsely been implicated in this case due to oblique motive. Learned counsel further submits that petitioner is in custody since 13.01.2021 and the charge-sheet, in the matter, has already been submitted.

Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 13.01.2021 and the chargesheet, in the matter, has already been submitted, I am inclined to grant regular bail to the petitioner after framing of charge. Accordingly, let the petitioner, MADHUSUDAN KUMAR be released on bail, after framing of charge, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon PS Case No. 22/2021.
