The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 307, 379, 354, 504 of the Indian Penal Code.
It is alleged that petitioners and 5 unknown came to the door of the informant and asked him to withdraw the earlier case lodged by him. On refusal of the same, Md. Shami Ahmad @ Md. Shami Ashmad, petitioner no. 1 abused and assaulted with sword on the head of the informant and Shamim Khatoon @ Shamina Khatoon, petitioner no. 2 tied the informant with rope and snatched gold chain from his neck.
Patna High Court Cr.Misc. No.54083 of 2015 (2) dt.30-11-2015 It is submitted by the learned counsel for the petitioners that case lodged by the petitioners' side was at earlier point of time. The injury has been found to be simple in nature. For the occurrence of 20.08.2015 the First Information Report was registered on 01.09.2015.
Considering the accusation in the background of land dispute and case lodged by the petitioners' side at earlier point of time, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 404 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
