In this case, the petitioner is apprehending his arrest in connection with Kasma P.S. Case No. 61 of 2015 registered for offences under sections 302, 201, 34 of the Indian Penal Code. As per allegation made by the Informant Guddu Kumar, his younger brother Vikas Kumar was taken by the coaccused Raju Kumar and Rahul Singh, they took meal and it appears that some altercation took place with the brother of the Informant, whereafter, co-accused Raju Singh assaulted his brother and with the help of Rahul Kumar Singh tied scarf around his neck who subsequently died on account of strangulations. The petitioner is not named in the First Information Report and the police has submitted final form in favour of the petitioner as well as similarly situated co-accused persons have been granted anticipatory bail by different Benches of this Court. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Sailendra Singh @ Sailendra Kumar Singh, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Kashma P.S. Case No. 61 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
