JUSTICE SHIVAJI PANDEY ORAL ORDER 02-02-2018 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Mansi P.S. Case No.263 of 2017, registered for the offence punishable under Sections 420, 409, 467, 468 and 471/34 of the Indian Penal Code. Allegation has been made that with the help of one Sanjiv Kumar, who is computer knowing staff, the petitioner and others have withdrawn the money from A.T.M. card of the informant. Allegation has been made that this petitioner has supplied his I.D. number and thereby assisted said Sanjiv Kumar in withdrawing the money, which is evident from C.C.T.V. footage. But, from the order of the Court below it appears that before lodging the present case, the petitioner and others have deposited the entire amount.

No.6105 of 2018 (2) dt.02-02-2018 2/2 Looking to the facts and circumstances of the case, let the petitioner, namely, Ajay Kumar @ Sri Ajay Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case No. 263 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
