Mr.Uday Pratap Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-04-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Rupaspur P.S. Case No. 332/2018, instituted for offences under Section(s) 302/34 of the Indian Penal Code read with Section 27 of Arms Act. Learned counsel for the petitioner has submitted that petitioner is not named in the written report. Informant has taken name of 11 accused persons raising suspicion against them. Name of this petitioner has transpired in the case on the basis of affidavit filed by the informant regarding his involvement in the case. Informant has filed aforesaid affidavit after fifty two days of the occurrence.

The other co-accused has already been granted bail by

Patna High Court CR. MISC. No.23006 of 2019(2) dt.10-04-2019 2/2 this Court in Cr. Misc. No. 20620/2019 dated 03.04.2019. Petitioner is in custody since 25.10.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IInd, Danapur, Patna, in connection with Rupaspur P.S.
