The present writ petition has been filed challenging the Letter No. 241 dated 03.10.2024 issued by the Block Panchayat Raj Officer, Bachhwara, in which it has been disclosed that the post of Nyaya Mitra of Gram Kachahari Dadupur has been vacated as the petitioner has completed 65 years of age on 19.10.2023.

3. Learned counsel for the petitioner submits that the petitioner discharged his duties and worked upto 29.07.2024. Therefore, he submits that the petitioner is entitled for the

Patna High Court CWJC No.7972 of 2025 dt.02-07-2026 2/3 honorarium for that period. Counsel submits that the petitioner was appointed on the post of Nyaya Mitra in the year 2008 and since then, he continued as Nyaya Mitra for Gram Kachahari Dadupur.

4. Learned Senior counsel for the State raised preliminary objection and submits that today, the petitioner has already completed 65 years of age and therefore, this writ petition has now become infructuous.

5. In the light of the submissions made, it transpires to this Court that as on date, the writ petition has become infructuous, as the petitioner has already completed 65 years of age.

6. Now, the only thing which is in dispute that on what date the petitioner has completed 65 years of age. In this regard, this Court specifically put a question to the counsel for the petitioner that whether he has brought on record the matriculation certificate or not, counsel for the petitioner submits that at present, he is not in a position to produce the matriculation certificate.

7. This Court is of the view that keeping this writ petition pending shall not solve any purpose. Instead thereof, this Court hereby directs the petitioner to file a fresh

Patna High Court CWJC No.7972 of 2025 dt.02-07-2026 3/3 representation before the District Panchayat Raj Officer, Begusarai (Respondent no. 3) annexing his date of birth certificate issued from the Board from where he has passed his matriculation. The petitioner shall produce the photo copy of the certificate in his representation and at the time of hearing, he is directed to produce the original certificate also, on the basis of which, the District Panchayat Raj Officer, Begusarai (Respondent no. 3) shall decide that whether on 19.10.2023, the petitioner has completed 65 years of age or not. If, it has been found that the petitioner has not completed 65 years of age on 19.10.2023, then he shall be entitled to receive honorarium upto the date on which he has completed 65 years of age.

8. Accordingly, with the aforesaid direction, this writ petition stands disposed off.
