The petitioner apprehends his arrest in connection with Mufasil P.S. Case No. 163 of 2016, registered under Sections 302 and 201/34 of the Indian Penal Code.

The accusation is that the marriage of Rukmini Devi, sister of informant, was performed with this petitioner before 30 years but the petitioner performed re-marriage. The second wife of the petitioner left the petitioner then he again performed the marriage with Manita Devi. Thereafter, sister of informant was being neglected and used to reside at his house. In March 2016, petitioner along with his second wife, Manita Devi and mother, Keshri Devi came at the house of the informant and accompanied his sister but he received information about killing of his sister on 19.09.2016 by four persons named in the F.I.R. including the

Learned counsel for the petitioner submits that, in fact, sister of informant, who is the wife of the petitioner, was suffering from abdominal problem and treatment was given to her, which would appear from paragraph 30 of the case dairy. Further submission is that she died on 19.09.2016 and thereafter the information was also given to the informant, on which, wife of the informant, his niece and nephew came and participated in the funeral but with ulterior motive the present case has been lodged after five days, which would appear from paragraph 8 of the case diary.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawadah in connection with Mufasil P.S. Case No. 163 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
