Prayer is for grant of anticipatory bail in Nawada Town P.S. Case No. 209 of 2017 registered under section 302/34 IPC. It is submitted that the petitioners are not named in the FIR. In course of investigation, their names transpired. It is stated that the accused persons named in the FIR with allegation have been granted bail by this Court. One of the coaccuseds who was not named in the FIR, but later his implication transpired, has, however, been released on bail. Counsel for the State, however, submits that it is a serious crime where the complicity of the petitioners transpired, but at a later stage of the investigation.
Patna High Court Cr.Misc. No.3000 of 2018(2) dt.16-01-2018 2/2 In the considered view of the Court, the petitioners should also surrender and pray for bail bringing to the notice of the court the order, referred to above, for consideration of the learned court below.
