2. The petitioner seeks bail in connection with Bhojpur Cyber P.S. Case No. 94 of 2024 registered for the offence under Sections 316(2), 318(4), 111, 317(2), 317(4), 317(5), 338, 340(1), 340(2), 3(5) and 61(2) of the BNS.

3. As per the prosecution case, the petitioner is accused of cheating the informant of Rs. 5,18,925/- by changing the ATM Card.

4. The petitioner is in custody since 7.12.2024.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case.

6. Learned counsel for the petitioner further submits that the petitioner is ready to return the amount of Rs. 5,18,925/- to the informant before or at the time of furnishing his bail bonds.

7. Considering the undertaking of the petitioner that he is ready to pay the alleged cheated amount to the informant, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara/concerned Court below in connection with Bhojpur Cyber P.S. Case No. 94 of 2024.

9. It is made clear that the Court below will only accept the bail bonds of the petitioner if he brings a demand draft of Rs. 5,19,000/- at the time of furnishing his bail bonds. If the petitioner does not bring the demand draft of Rs. 5,19,000/- then the bail bonds of the petitioner shall not be accepted and expedite the trial of the petitioner.

10. It is also made clear that if the petitioner brings the demand draft of Rs. 5,19,000/- then the same shall be released in favour of the informant by the Court below. (Sandeep Kumar, J) Vikas/- U
