Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State video conferencing. The petitioner apprehends his arrest in connection with Bidupur P.S. Case No. 275/2020 registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

Petitioner is the brother-in-law (Sala) of the deceased who was staying in his sasural i.e., house of the petitioner, along with his wife and children. It has been alleged by the informant who is the stepbrother of the deceased that the entire family from the sasural side of the deceased including his wife Putul Kumari were involved in the killing of the deceased.

No.34501 of 2021(2) dt.09-02-2022 2/2 It has been submitted on behalf of the petitioner that the informant being the stepbrother of the deceased has falsely implicated the wife, brother-in-law and other members of the family so that wife and daughter of the deceased do not claim property rights in his paternal property.

There is no evidence to even remotely connect the petitioner and other accused persons with the death of the deceased.

Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of ten weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Hajipur, Vaishali, in connection with Bidupur P.S. Case No. 275/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
