ANJANA MISHRA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.02.2019 in connection with Sitamarhi P.S. Case No.1123 of 2018 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were from the straw kept on the land which was the Government property and not from the private personal possession of the petitioner. He further submits that the petitioner has been falsely implicated in this case as he was earlier implicated and remanded in connection with another case.
