2. The petitioner has preferred this application for grant of regular bail in connection with Harsidhi P.S. Case No. 68 of 2024 dated 13.02.2024 registered for the offences punishable u/ss 364A read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, unknown miscreants are alleged to have kidnapped the informant's son by vehicle bearing Reg. No. BR-01-FY-9395 (white Tata Nexon) and the accused person also called the informant by mobile number 9572182900 and demanded Rs. 3,00,000/- as ransom.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.24743 of 2025(2) dt.07-05-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has surfaced in this case in the confessional statement of the co-accused, Vivek Kumar Singh. The petitioner is neither the owner of the mobile number nor the owner of the said vehicle and he has no concern with the alleged offence. No T.I.P. has been conducted by the prosecution. The statement of the informant's son recorded under Section 164 of the Cr.P.C. has not stated the name of the petitioner in the alleged crime. The petitioner has five criminal antecedents in which he is on bail in all cases as stated in para 3 of the bail petition. The petitioner is in custody since 05.02.2025. The co-accused person has already been granted regular bail by this Court vide order dated 25.06.2024 passed in Cr. Misc. No. 42431 of 2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sadar, Motihari, East Champaran in connection with
Patna High Court CR. MISC. No.24743 of 2025(2) dt.07-05-2025 3/3 Harsidhi P.S. Case No. 68 of 2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
