2. In the present case, the petitioner seeks bail in connection with Imamganj P.S. Case No. 289 of 2023 registered for the alleged offences under Section 394 of the Indian Penal Code.

3. As per prosecution case, four miscreants accosted the informant and they fired upon the friend of the informant but the shot missed. Thereafter, the informant was assaulted and he fell down and the miscreants snatched mobile phone, wallet and cash and also his biometric machine and the motorcycle. The name of the petitioner transpired during investigation for being involved in the occurrence.

4. Learned counsel for the petitioner submits that

The name of the petitioner sprang up in this case in the confessional statement of co-accused Mewalal Kumar, who has been granted bail by the learned subordinate court. Nothing incriminating has been recovered from this petitioner and he has not been put to Test Identification Parade. The petitioner is in custody since 04.01.2025 and charge sheet has been submitted. The petitioner has got no criminal antecedent.

5. Learned APP opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the submission of charge sheet, period of custody of the petitioner and grant of bail to similarly placed co-accused, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sherghati, Gaya/concerned Court in connection with Imamganj P.S. Case No. 289 of 2023, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
