The petitioner apprehends his arrest in connection with Araria (R.S.) P.S. Case no. 760 of 2018, registered under Sections 379 and 411 of the Indian Penal Code. Petitioner and co-accused Mustehasan Sayyhad are said to have stolen the motorcycle of the informant. Aforesaid motorcycle was found parked on the road in the market with registration number plate detached.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case by Md. Adil Reza due to animosity. Aforesaid motorcycle was not seized from the possession of the petitioner rather was

Patna High Court CR. MISC. No.24791 of 2019(2) dt.18-04-2019 2/2 recovered from the market. Subsequently the parties to the case compromised the case realising giving the name of the petitioner in the case due to misunderstanding. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Araria (R.S.) P.S. Case no. 760 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
