The petitioner has been in custody since 17.07.2018 in connection with Mahua P.S. Case No. 110/2018 registered for the offense punishable under Sections 395/397 of the Indian Penal Code.
Learned counsel for the petitioner submits that he has been taken into custody in connection with the Bank dacoity in which some miscreants had looted cash to the tune of Rs. 10,61,027/. It is submitted that the petitioner is not named in the F.I.R., but subsequently, on the basis of some investigation, the petitioner has been falsely implicated in connection with the present case. It is further submitted that no incriminating article has been recovery from the possession of the petitioner nor has
Patna High Court CR. MISC. No.24906 of 2019(2) dt.18-04-2019 2/2 he been placed on T.I.P. It is also submitted that other similarly situated co-accused persons has since been extended the privilege of bail by this Hon'ble Court in Cr. Misc. No. 74209 of 2018 vide order dated 13.12.2018.
Considering the aforementioned facts and circumstances and that the petitioner's name has surfaced merely on suspicion, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S.
