This is an application for grant of anticipatory bail in connection with Bakhri P.S. Case No. 111 of 2016 registered for the offence punishable under Sections 364 of the Indian Penal Code.
The allegation is regarding disappearance of one Sonu Kumar, who is traceless till date.
The learned counsel for the petitioner submits that the records would bear it out that the said Sonu Kumar was having an illicit relationship with one Manisha Kumari whose husband Deepak Anand is also an accused in the present case and upon the confessional statement of the mother of the co-accused Deepak Anand, the name of the petitioner has transpired in the
Patna High Court Cr.Misc. No.1426 of 2018(2) dt.15-03-2018 2/2 present case and the petitioner happens to be the brother-in-law of the said co-accused, namely, Deepak Anand. It is further submitted that no complicity of the petitioner can be found from perusal of the entire case diary. It is submitted that the coaccused Deepak Anand and Manisha Kumari have already been granted bail by this Court vide order dated 22.02.2017 passed in Criminal Misc. No. 344 of 2017. The petitioner is having a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai, in connection with Bakhri P.S. Case No. 111 of 2016, G.R. No. 1888 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) S.Sb/- U T
