The petitioners are apprehending their arrest in connection with Katra P.S.Case No. 05 of 2017 registered for the offence under Sections 147, 148, 149, 323, 353, 379, 385, 427, 447, 504 and 506 of the Indian Penal Code.
Allegation against the petitioners and various other accused persons is of assaulting and damaging public properties. Submission of learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners and nothing specific has been attributed against the petitioners. Heard learned APP also.
Having heard both sides and in view of the fact that
Patna High Court Cr.Misc. No.36526 of 2017 (2) dt.10-08-2017 2/2 petitioners are named in the FIR and there are allegations against them, this is not a fit case for grant of anticipatory bail to the petitioners, rather let them surrender and pray for regular bail, which will be considered on its own merit, without being prejudiced by this order, and disposed of, preferably on the same day.
With the above observation, this application is disposed of.
