1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Chandi P.S. Case no.92 of 2022 registered under sections 302 and 34 of the Indian Penal Code.

3. As per the prosecution case, it is stated by the informant that the tempo being driven by his son accidentally touched the tempo coming from the other side in which the five named accused persons including the petitioner herein were seated. It is thereafter stated that they pulled the son of the informant and the accused persons assaulted him. On being taken to the hospital, he was declared dead.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.25451 of 2023(2) dt.19-05-2023 2/2 that the petitioner has been falsely implicated in the case. The manner of occurrence is other than what has been narrated in the F.I.R. The allegations are general and omnibus in nature. A number of similarly situated co-accused have been enlarged on bail vide order dated 15.2.2023 passed in Cr. Misc. no. 58441 of 2022 and order dated 30.8.2022 passed in Cr. Misc. no.31787 of 2022. The petitioner is in custody since 14.2.2023 and has no criminal antecedent.

5. Heard learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation against the petitioner in the F.I.R, grant of bail to similarly situated co-accused, the petitioner having remained in custody since 14.2.2023 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Chandi P.S Case no.92 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara.
