The present petition has been preferred for quashing of the order dated 8.6.2015 passed by the learned Chief Judicial Magistrate, Nalanda at Biharsharif, Rajgir P.S. Case No. 47 of 2013 under section 420 of the Indian Penal Code whereby cognizance has been taken against the petitioner under section 420 of the Indian Penal Code.

As per the prosecution story, the S.D.O., Rajgir got information that on the ground of passing of the students in the practical exam, amount is/are being realized in the R.D.H., High School, Rajgir.

Accordingly, the school in question was raided in which in room no.21, the petitioner and other accused persons

Patna High Court CR. MISC. No.53092 of 2015(2) dt.20-03-2023 2/2 were found the amount realized in handkerchief and was kept on the bench. The same was seized and accordingly, the case. The police investigated the matter and submitted charge-sheet followed by cognizance dated 8.6.2015 under section 420 of the Indian Penal Code in connection with Rajgir P.S. Case No. 47 of 2013.

Having gone through the facts as also the materials on record, no case for interference is required. Accordingly, the petition stands dismissed.
