JUSTICE RAKESH KUMAR ORAL ORDER 24-08-2016 Heard Sri Bindeshwar Sah, learned counsel for the petitioners and learned Addl. Public Prosecutor. Three petitioners have approached this Court by way of filing a petition under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in Sheohar SC/ST P.S. Case no.25/2015 registered for the offence under Sections 341, 323, 354, 504, 506/34 of the Indian Penal Code and Section 3(1)(x) of Scheduled Castes & Scheduled Tribes(Prevention of Atrocities) Act.
Learned counsel for the petitioners submits that petitioners were on police bail. Accordingly, the Court is of the opinion that since the petitioners have been granted bail by the
Patna High Court Cr.Misc. No.31790 of 2016 (2) dt.24-08-2016 2/2 police, there is no question for entertaining the petition for anticipatory bail.
The petition stands dismissed.
