JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2016 The present application has been filed for modification of the order dated 14.09.2015 passed in Cr. Misc. No. 37038 of 2015.

Learned counsel for the petitioner confines his prayer only to the extent of extending the period of surrender.

It is submitted by learned counsel for the petitioner that petitioner resides at Punjab, hence he was not aware for the grant of bail.

On the grounds mentioned in the modification application, the period of surrender is extended further for a period of three weeks from the date of receipt/production of the copy of this order. However, this modification application will be valid only if the petitioner files an affidavit that he was never been made an accused in any other case since 14.09.2015 till date and if it is found that

Patna High Court Cr.Misc. No.30816 of 2016 (2) dt.27-07-2016 2/2 petitioner has been made accused in any other case during the aforesaid period, in that circumstance, the petitioner will surrender and pray for regular bail.

The order dated 14.09.2015 stands modified to the extent indicated above.

Accordingly the modification application is disposed off in connection with Makhdumpur(Tehta O.P.) P.S. Case No. 143 of 2015, pending in the court of leaned Chief Judicial Magistrate, Jehanabad.
