The petitioners apprehend their arrest in connection with Baniapur P.S. Case No. 66 of 2017 registered under Sections 302 and 201 read with Section 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioner no. 1 is the younger brother of the husband of the deceased, the petitioner no. 2 is the mother-in-law and the petitioner no. 3 is the 'Gotni' of the deceased and all of them are residing separately in mess and business. The father-in-law Yadunath Rai has already been arrested and is in custody. Learned counsel further submits that save and except that all these petitioners have been named in the F.I.R. with general and

Patna High Court Cr.Misc. No.31673 of 2017 (2) dt.13-07-2017 2/2 omnibus allegations, there is no specific allegation of demand of dowry on earlier occasion by these petitioners and, therefore, the implication of these petitioners are only with an intention to harass the whole family.

No one appears for the State.

In the facts and circumstances of the case, let the petitioners, named above, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be enlarged on bail on their furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 11, Saran at Chapra in connection with Baniapur P.S. Case No. 66/2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
