The petitioner apprehends his arrest in Beur P.S. Case No. 90 of 2022, registered for the offence punishable under Sections 30(a), 36, 41 and 44 of the Bihar Prohibition and Excise Act, 2018.

962.43 litres of Indian mad foreign liquor has been recovered from a room situated on ground floor. It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner is not the owner of house in question and has got no concern with the alleged recovery.

Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent

Patna High Court CR. MISC. No.26046 of 2022(2) dt.05-08-2022 2/2 and three cases of similar nature are pending against him. Considering the criminal antecedents of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail.
